View All NewsThe Australian government has two visa subclasses available for foreign individuals in a relationship with or is married to an Australian citizen, Australian permanent resident or eligible New Zealand citizen who is living in Australia.
Today we will focus on the Partner Visa (Subclass 820), as well as what you need to know when you are applying for a Partner Visa (Subclass 820) within Australia.
Partner Visa (Subclass 820)
The Australian partner Visa allows the partner or the spouse of an Australian citizen, or an Australian permanent resident to reside in Australia.
You can apply for a Partner Visa (Subclass 820) if:
- you are in a de facto or registered relationship with or is married to an Australian citizen, an Australian permanent resident, or eligible New Zealand citizen. The case office will expect your relationship to meet the following:
- the couple have a mutual commitment to a shared life as husband and wife to the exclusion of all others;
- the relationship is genuine and continuing;
- the couple live together, or do not live separately and apart on a permanent basis; and
- they meet the Health and Character requirement.
- you are living in Australia during the time of your application;
- you hold another type of visa issued by the Australian government (visitor visa, working holiday visa, student visa, etc.); and
- you have not been issued a “No Further Stay (8503)” condition.
The most appropriate visa application may depend on whether you have been living together and for how long or are engaged or married. In all cases, strong evidence of a genuine and on-going relationship is needed. This applies even to married couples, so simply rushing out and getting married will not make a person eligible for a partner visa.
