Liqour Licences

If you want to sell or supply liquor in South Australia, you must obtain a liquor licence. Depending on the type of activity or business you wish to undertake, you will need one of twelve different liquor licences. They are:

- Club licences;

- Direct sales licences;

- Entertainment venue licences;

- Hotel licences;

- Limited club licences;

- One-off event (limited) licences;

- Producers liquor licences;

- Residential liquor licences

- Restaurant liquor licences;

- Retail liquor licences;

- Small venue liquor licences;

- Special circumstances licences;

- Wholesale liquor merchant licences; and

- Wine export licences.

Each licence has its own application and different procedures must be followed. There are also different requirements that have to be adhered to for each licence. For example, the person applying changes depending on the ownership structure of the business. For that reason, it is always good to speak with your solicitor before applying for a liquor licence.

Transferring a current liquor licence

As part of the sale or purchase of a business, you may wish to effect the transfer of the liquor licence the business currently holds. In such a case, the purchasers of the business must apply for the licence to be transferred to them.

This must be done after the title to the premises or the lease agreement has been transferred to the purchasers as a copy of the lease agreement or title reflecting the ownership change must be provided. Different requirements will also apply depending on factors such as the ownership structure of the purchaser. As above, it is good for that reason to speak with a solicitor to help you understand.
