Mediation
Mediation is an excellent collaborative practice and an alternative to the traditional court-based approach to family law disputes, allowing both parties to reach an agreement with less tension, and often with lower legal costs.
This practice provides a space for you and your former partner to discuss important issues, resolve misunderstandings and come to mutual agreements that will benefit each of you and your children. Once both parties come to an agreement, the parties’ lawyers will create an amicable and non-adversarial agreement on terms that is mutually agreed upon in the form of a binding and legally enforceable document.
There are a number of other significant benefits of mediation and they include:
- Greater control. Each party are directly involved in negotiating their own agreement and no settlement can be imposed upon you. In comparison, dissatisfaction is often experienced in court where parties have little choice but to accept the judgement made, which they may not be happy with.
- It is voluntary. Any party may withdraw at any time.
- Less costly. Generally the cost is greatly reduced in comparison with trying to settle the matter through court. The mediation process is often a more efficient and informal way to settle with each other.
- More effective and faster outcome. Typically in a mediation scenario and if both parties are willing, an agreement can usually be reached quicker than if pursuing through the courts.
